Terms and Conditions - Reward Scheme

Definitions

In these Terms and Conditions unless the context requires otherwise:

"Member" means the person who is a member of the Scheme and whose name is registered on the account;

"Reward Points" means the credits denominated as Reward Points as earned by a Member and credited to a member's account;

"Scheme" means The Reward and Status Points Scheme;

"Status Points" means Status Points earned by Members for the purpose of progressing towards Silver or Gold membership. Status Points are separate from Reward Points and are awarded according to the conditions specified on the Website;

"We" means Hornby Hobbies Ltd

"Website" means www.scalextric.com

  1. The Scheme is operated and promoted by Hornby Hobbies Ltd, Westwood, Margate, Kent, CT9 4JX.
  2. To be eligible for the Scheme you must register an account at the Website.
  3. The registration form (including the online registration form) forms part of these terms and conditions. We reserve the right to vary these terms and conditions as necessary during the Scheme for the purpose of introducing new points offers or rewards or for implementing other changes to the Scheme, for legal or regulatory reasons, in the event of a Member's dishonesty, misuse of the Scheme or failure to comply with these terms and conditions. Details of these changes will be posted on the Website and may be notified to registered Members by post or email where we consider the change requires additional communication.
  4. Status Points and Reward Points will only be earned on every complete £1.00 spent.
  5. Reward Points are awarded at the rate of 5 per £1 spent rounded down to the nearest pound for Standard Status members.
  6. Reward Points are awarded at the rate of 10 per £1 spent rounded down to the nearest pound for Gold and Silver status members.
  7. Entitlement to Gold or Silver status depends on the applicable level of Status Points earned by Members. We may from time to time, change the number of Status Points needed to qualify for each type of membership but will inform Members in advance of any changes. For details on the applicable level of Status Points needed for each level of membership please see the Website.
  8. We reserve the right to withdraw any Reward Points or Status Points from the Scheme, at any time, including for legal or regulatory reasons.
  9. We reserve the right to refuse to award Reward Points or Status Points to redeem Reward Points, or any rewards, for any breach of these terms and conditions or failure by a Member to pay for goods or services.
  10. We reserve the right to vary the rate at which Reward Points or Status Points are awarded and the value that each Reward Point can be redeemed for in the Scalextric website shop.
  11. We reserve the right to withdraw or cancel any individual membership to the Scheme for legal or regulatory reasons, in the event of a Member's dishonesty or misuse of the Scheme (where there are reasonable grounds for suspecting dishonesty or misuse) or failure to comply with these terms and conditions.
  12. A minimum of eight weeks notice will be given prior to the end of the Scheme. This notice period will be communicated via the Website. Reward Points must be redeemed by the date which falls 28 days after the end of the eight week notice period ("the final redemption date").
  13. We may apply such reasonable restrictions, conditions or further requirements in connection with the issue or redemption of Reward Points either generally or in respect of a particular Member and may require proof that Reward Points have been acquired properly (i.e. in accordance with these terms and conditions).
  14. A Member's Status level will be reset to Standard and their Status points will be reset to zero if the Member does not make a purchase within a 12 month period. The Member's Reward Points are not affected and can still be spent in the Scalextric Shop at the prevailing rate.
  15. If a Member does not log into their account for three years then their Reward Points and Status Points will be written off and their membership status will be cancelled.
  16. Reward Points and Status Points are not transferable and can only be used by the Member who is registered on the account.
  17. Reward Points can be only redeemed against any purchase from the Website.
  18. The personal information provided by customers when applying for the Scheme shall be used strictly in accordance with the data protection legislation applicable in the UK and the privacy policy as set out on our Website.
  19. Reward Points and Status Points have no cash redemption value and cannot be exchanged, sold or transferred.
  20. The Scheme is for consumer use only and membership is not available to any business entity.
  21. Customers will only earn Reward and Status points when they spend money on the Website. Where Reward Points are redeemed as part payment, Reward and Status Points will be awarded for the cash balance only.
  22. These Terms and Conditions are governed by the laws of England and Wales are subject to the non-exclusive jurisdiction of the English courts.
